Supreme Court Denies Derek Chauvin Appeal Challenging Prison Sentence

The Supreme Court denied former Minneapolis police officer Derek Chauvin’s appeal of a lower-court ruling sentencing him to more than 20 years in prison for the murder of George Floyd.

Chauvin’s legal team filed the appeal last week, arguing that the Minnesota cop’s trial was held during a contentious time in the country, leading to concerns about the jury’s impartiality.

Chauvin is currently serving his 22.5-year sentence after a Minnesota court’s jury found him guilty of second and third-degree murder in April 2021. The Minnesota Court of Appeals and the state supreme court both upheld the lower-court ruling before the case was raised before the U.S. Supreme Court this month.

Derek Chauvin had a fair trial. Everyone on the jury was impartial since Derek Chauvin’s legal team examined each witness BEFORE signing off on them to participate as jurors and so why Chauvin is continuing to state that he did not receive a fair trial is a damn mystery to me. He was tried and convicted by a jury of HIS peers. Won’t no Black folks sending his ass to prison, he sent his own ass to prison and he probably should have been sent to prison years ago for the vicious and illegal shit he had been up to the entire time he was on the Minneapolis Police force. That shit is so criminal that the Justice Department, put in a place, a consent decree, and what’s more the shit is still fucked up. 

Derek Chauvin’s skin-head Klan ass is right where he should be and what’s more, he should have been given more time to serve, but being all pink-assed and his victim, being all Black-assed, no one with more than two brain cells connected and working was so delusional that they figured he would get more time, which he surely deserved. He’d better have been glad that my ass wasn’t on the jury because the jury would still be out since I would have been the lone hold-out on his ass getting a FIRST-DEGREE MURDER CONVICTION! So, be grateful for small favors, bitch!

Derek Chauvin’s ass would not have been able to sue ALL the way to the fucking Supreme Court if he was footing the damn bill for his legal services, but since taxpayers are paying for that shit, he is still getting carte blanche when it comes to legal services since his shit made it all the way to the Supreme Court when there are many more serious cases that the Supreme Court refuses to even hear. He’s still getting the ‘kid glove’ treatment, as far as legal services and in prison, no doubt. I am quite sure that that skin-head is not eating what regular convicts are eating since his ass is segregated because he would surely, by now, have had BIG CALVIN land on HIS damn neck, with malice aforethought! But I shall certainly keep hope alive that his neck gets ‘Knee’d’. He’d be no great fucking loss. The world would stand to gain when his ass is no longer sucking air.

Chauvin has some nerve talking about how he could not have received a fair trial when his victim cannot receive his life back and those yahoos are still trying to say that Chauvin did not murder George Floyd since some piece of shit is claiming that ‘methamphetamine and fentanyl contributed to Floyd’s death’. What the fuck??!! How the hell did meth and fentanyl contribute to George Floyd’s death when neither meth nor fentanyl was kneeling on Floyd’s neck at the time of his murder? Derek Chauvin was doing that shit. I said before this shit even went to trial that George Floyd’s death was going to be caused by everything under the sun OTHER than Chauvin’s knee on his neck. I stated that Floyd would have been accused of kneeling on his own damn neck, while also expiring from vicious gout, flaming Gastroesophageal reflux disease, chronic toenail fungus and ferocious whiplash. And I have since, been proven right. 

Now that the Supreme Court has weighed in and has the final say, maybe that bastard can sit the fuck down and shut the fuck up and ruminate on why his ass is so damn racist. Oh, never mind! My bad! He is still pretending as though he had absofuckinglutely nothing whatsoever to do with George Floyd’s murder. Flaming racist skinheads will never rein their fucking racism in and will continue to blame their victims for the vile ass criminal acts that flaming racists commit. Rot in prison, bitch! A Case Of Two Wrongful Death Settlements

 

First, the Breonna Taylor ‘wrongful death settlement’ that has been heralded as the largest settlement of its kind in the history of Louisville, Kentucky; $12 million.

Breonna Taylor’s Family Historic Settlement a Good Start … But We Demand Full Justice!!!

Breonna Taylor’s family and legal team are giving praise to the City of Louisville for reaching a historic settlement in her wrongful death case, but they’re making it crystal clear their mission’s not changed … they want full justice for Breonna, and for the cops who killed her to be arrested and charged.

Attorney Ben Crump says the huge financial settlement has helped assure that Breonna’s death won’t be swept under the rug like so many black women before her, but equally important is the comprehensive police reform to be instituted to prevent future tragedies like Breonna’s.

Crump claims the $12 million settlement is the largest amount ever for a Black woman in a wrongful death case involving police, and may be the largest ever for a Black person in America.

Also, according to Louisville’s mayor,Greg Fischer, there will be lots of police reform to ensure that what happened to Breonna Taylor will not happen to anyone else and so now, everyone can rest easy in their beds who actually believe that bullshit. Not only that, but calling this settlement, ‘historic for a Black woman’ is the absolute end of enough and a direct slap in the face to every Black woman in Amerikkka. $12 million lousy dollars for a wrongful death settlement when Breonna Taylor will NOT get to spend one damn dime of that money. That money is cold comfort to equally cold and dead Breonna Taylor. That pittance is no more than ‘hush’ money because I don’t care how many ‘reforms’ the mayor claims will be instituted, the racist criminal justice system cannot be reformed. It needs to be totally dismantled because it is the former slave patrol on steroids; it just morphed into more of a monster than it started out to be and that’s saying something.

If Breonna Taylor had been my daughter, I would have told the city of Louisville, Kentucky where to stick their lousy ass twelve million. My daughter’s life, would not have been reduced to a twelve million dollar payout when she was as innocent as a newborn baby because she had done nothing wrong. Breonna Taylor was asleep in her home and kops bust down her door and shot her without even bothering to check that the suspect they were after had already been apprehended and as of today, not one kop has been charged with her murder and now the concentration is on the fact that twelve million dollars has been declared the biggest payout in the history of Louisville Kentucky for a wrongful death lawsuit over a Black woman and so be grateful, sit the fuck down and shut the fuck up because ‘history’ has been made. Never mind that no one on the scene of Breonna’s murder even bothered to render aid to her. Not one of those racist thugs that bust down her door even bothered to glance at her, they just went about the business of searching for drugs and found none. Breonna Taylor’s lifeless body, by then, was a mere afterthought and yet I’m going to stand somewhere and claim a twelve million dollar “shut the hell up about it” settlement is something to write home about? Nothing fucking doing!

I don’t give a shit that Breonna Taylor’s mother and her attorney, Ben Crump are still claiming that they are insisting that the kops that murdered Breonna Taylor be arrested and charged with murdering her. I don’t give a damn about Ben Crump calling for all charges to be dropped against protesters who protested the kops killing Breonna Taylor because as far as the whites are concerned, it’s done. It’s over. Next! And just how much do you seriously think that Breonna Taylor’s ‘estate’ is going to receive after Ben Crump takes his cut because believe me, the attorney ALWAYS walks away with the majority of any settlement monies because if they did not, would there be as many attorneys as there are? And why is it that Ben Crump only takes ‘high profile’ cases? It is because the public does his work for him. The public assures Ben Crump of making millions by effectively doing his work for him while he sits in his office, leans back, puts his heels up and watches the news for the latest protests on Breonna Taylor’s behalf. If Ben Crump was so concerned about those protesters being released from jail, then with his considerable fortune, why did he not represent them, bail them out and stand at a press conference and speak about what a wonderful job they did on helping him to reach a settlement with the city of Louisville, Kentucky?

Crump says, “We want full justice, not just partial justice,” and is also calling for all charges to be dropped against nonviolent protesters who were arrested for demanding justice for Breonna. He attributes the victory to all the people who have been protesting and fighting for justice.

That Uncle Tom piece of shit is just another bloated windbag sellout who is nothing more than a dirty, snake of a lawyer with not a grain of integrity, honor or ethics just like ALL attorneys, bar none! And I should know. I have had enough dealings with them.

And so we come to the next case.

Judge Approves $20M Settlement For Justine Ruszczyk Damond’s Family

MINNEAPOLIS (WCCO) — The largest police settlement in Minneapolis history has been approved.

On Tuesday, a City of Minneapolis representative confirmed that state district court Judge Mary Vasaly approved the $20 million settlement with the family of Justine Ruszczyk Damond.

Of that settlement, the distribution is as follows: $5.7 million goes to Justine Ruszczyk Damond’s brother, Jason Ruszczyk, $5 million to her father, John Ruszczyk, and $1 million to her fiancé, Donald Damond. Approximately $6.3 million goes to attorneys’ fees.

Another $2 million goes to the Fund for Safe Communities at the Minneapolis Foundation. The fund is a program to fight gun violence in the city.

Ruszczyk Damond was shot and killed by then-officer Mohamed Noor in 2017. A jury found Noor guilty of third-degree murder and second-degree manslaughter.

Convicted former police officer, Mohamed Noor, is serving a twelve year, six month sentence for killing Justine Damond. But of course, look at who did the dying and who did the murdering.

 

Mohamed Noor shot Justine Damond because he ‘claimed’ to have heard a noise and fired his gun, thus killing Justine Damond as she stood by his patrol car after she had called the police on a suspected sexual assault occurring outside in the alleyway behind her home. Noor and another officer responded. Neither exited the patrol car and Damond walked up to it and was shot by Noor.

The whites in Damond’s upper class south Minneapolis neighborhood went the fuck off, demanding justice for Damond and calling for the heads of several city employees including the chief of police and the mayor, which they received since the mayor, Betsy Hodges is mayor no more and the police chief was forced out as well. No one had to protest or lift a finger really because justice was going to be served FOR Miss Australian Justine ‘goldilocks’ Damond. The ‘wall of blue’ that usually surrounds kops that go on murdering sprees was nowhere to be found in this case since Noor is behind bars even though he claimed the usual that gets ALL white kops off, “I feared for my partner’s life and so I fired my gun.” The partner, who was white, was quite in shock and said so because it was his contention that he did not ‘fear for his life’ and so did not know why former officer Noor fired his gun. But be that as it may, why does Justine Damond’s wrongful death settlement garner a $20 million dollar payout while Breonna Taylor’s garners a $12 million dollar payout? Notice any glaring difference? I’ll give you a hint.

 

Now, take into consideration that Justine Damond CHOSE to come to this shithole. Former Somali cop Mohamed Noor CHOSE to come to this shithole. Who did not? Breonna Taylor and so why did IMMIGRANT Justine Damond’s family received $20 million dollars when her ass would still be alive if she had not IMMIGRATED to this shithole from Australia? Not only that, but IMMIGRANT Mohamed Noor would not be sitting up in prison for killing Damond if his ass had remained in Somalia. Both had passports and yet, both were involved in a similar case as Breonna Taylor’s and yet, Breonna Taylor’s murderers have NOT been brought to justice. No charges have been filed and Breonna’s estate is to receive $12 million, minus attorney’s fees, of course. And as you can see in the above quotes, the attorney on the Justine Damond case received more in attorney’s fees than any of Justine Damond’s loved ones. But the same is going to happen in the case of Breonna Taylor’s settlement. Ben Crump will make out like the bandit he is, while Breonna Taylor’s estate will receive the crumbs he doles out.

Not to mention, what police reforms were put in place in Minnesota to stop the senseless murder of unarmed innocent citizens because even though Philando Castile had a gun when he was pulled over, he had a permit to carry that gun and yet, what did he receive for his actions of complying with the kop that murdered him? Dead. That’s what he got and the wrongful death settlement reached on behalf of his estate? A three million dollar settlement. That’s justice, right?

Again I ask, where were the police reforms after Philando Castile was murdered in 2016? Where were the police reforms after Justine Damond was murdered in 2017? And so why are we then to suppose that there will be police reforms after the murder of Breonna Taylor in 2020 especially seeing as how there were mass protests, worldwide with the murder of George Floyd in May of this year? Where are the police reforms? Who needs or wants to hear more lies from mayors and police chiefs and police unions about reform of the criminal justice system which needs to be dismantled, nationwide? How many more people need to lose their lives at the hands of the state before the people take action and put paid to those murdering animals for good because make no mistake, kops are going to go on killing mostly American descendants of slavery and no amount of protesting is going to make that shit stop. No amount of payoffs is going to stop that because taxpayers are footing the bill for those settlements.

The citizens of this country need to take a leadership stance and demand that the entire racist criminal justice system be completely dismantled because it is mostly made up of members of hate groups and what’s more, that shit is well known by police departments all across this shithole. Mohamed Noor was made to pay for the killing of Justine Damond because he was not really one of the ‘boys in blue’ which are code words for ‘white supremacy’ groups. And make no mistake, the only reason Derek Chauvin is sitting behind bars is because who the fuck couldn’t see that he deliberately and with malice aforethought and with intent to kill, did indeed, kill George Floyd and now want to blame George Floyd’s death on Fentanyl. We ALL know that fentanyl did not kill George Floyd, Derek Chauvin and the rest of the ‘boyz in blue’ killed him and so, I ask, yet AGAIN, where are the promised POLICE REFORMS? Because they are certainly non-existent in Minneapolis and they will be just as non-existent in Louisville, Kentucky. But now that Breonna Taylor’s mother, Tamika Palmer, can take her $3 million dollar cut from the whopping $12 million dollar insult to Breonna, all’s well that ends well until another high profile case makes the headlines and all over it like flies on shit, Ben Crump will be and he will have the protesters to thank for doing his job for him, but they will receive from him, nothing but useless thanks because he damn sure as hell will not use his substantial dirty money to represent them or bail them out of jail.

The lives of Black women don’t count for shit to these racists in Amerikkka and what’s more our lives never will. A $12 million dollar payout is an insult to the memory of Breonna Taylor and her mother should be ashamed of herself for making such a big deal over hush money and an attorney that is a criminal his damn self and who is certainly NO friend to American descendants of slavery. Downtown Minneapolis’ Residential Boom Reversing As Crime Rises, Businesses Shutter

MINNEAPOLIS (WCCO) — The once-burgeoning downtown Minneapolis can be hard to recognize these days: empty storefronts, empty sidewalks. And on several nights, unrest has filled the streets.

“Now because of what’s going on with the pandemic, and now the civil unrest, in my condo building downtown we have a record 21 lock boxes.  We’ve never had this many people leaving the building. It’s shocking,” LaBelle said. “They’re selling their units because they don’t want to live in an unsafe environment.”

I remember when I lived in Minneapolis and they were in the process of building those luxury high rise condos downtown. I remember seeing the two Minneapolis’s converge; on the one hand, you had the people who were obviously well off, sitting outside of upscale dining establishments, eating and drinking with not a care in the world, while on the other hand, across the street, a homeless man would be sitting on the sidewalk with a cardboard sign or there would be a man standing near Target, playing a guitar while only a handful of people threw some coins into the little box he hoped to fill. There was even a homeless veteran sitting further down and I took some pictures just to showcase the life of the haves and the have nots. The photos are small because I was using an old flip phone I had, but this is what I managed to dig up.

Never once did I see ANY of those poor homeless people commit a crime. What was their ‘crime’? They were poor. But now that Minneapolis cannot get a handle on its soaring crime problem thanks in part to the whites who simply chose to ignore a festering problem until that problem finally came home to roost, the whites have no choice but to sit up and take notice of what they had long been ignoring. Now there are calls for social justice. Now there are calls for affordable housing in downtown Minneapolis. Why? Because the whites are terrified to the point whereas some are fleeing because whites always have the money to flee from any unpleasantness; anything that could ruin their ‘happy hour’ or their stroll to Target Field to watch a Twins baseball game.

Couple assaulted in downtown Minneapolis, police investigate

MINNEAPOLIS — A couple in Minneapolis are sharing their story after they say they were randomly attacked by a group of eight to 10 people downtown Friday night.

The couple, who did not want to identify themselves out of safety concerns, say it happened at the intersection of North 5th Street and 2nd Avenue in the North Loop just after 10 p.m.

Yes indeed, that would have been unheard of just a few short years ago. But now, the scene in downtown Minneapolis on any given day is one of a ‘ghost town’ and I highly doubt that is about to change because when Minneapolis gave us a look into what Minneapolis is ALL about when Derek Chauvin knelt on George Floyd’s neck for damn near ten minutes until he killed him, that put paid to that shit about the whites having Minneapolis on lockdown. The shit has been hitting the fan since then. Those who have been forced to live like shit are letting go and the whites who just want to fuck shit up, are also doing the same. Everybody is making damn sure that Minneapolis continues to be front and center in the news for exactly what Minneapolis has always been about; making sure that the downtrodden has stayed downtrodden and that wealthy whites could sit back and enjoy themselves without worry about ‘those’ people infringing on their enjoyment of a city that should include ALL people and not just wealthy WHITES.

Dozens Of Businesses Consider Moving Out Of Downtown Minneapolis

MINNEAPOLIS (WCCO) – Downtown Minneapolis is at risk of losing dozens of businesses.

Cruising through downtown Minneapolis is not what it once was. On some stretches the largest city in the state looks more like a ghost town.

A new survey by the Downtown Council shows 45 business owners say they are considering leaving downtown – citing the lack of people working or socializing downtown – and the idea that the police department could be dismantled.

Though they won’t say which businesses are considering pulling out of downtown, the council says one of the businesses employs 600 people.

That could mean a lot of empty spaces.

I was so damn glad to read this, it ain’t even funny! That’s just what this damn city deserves and I knew it was coming. Because when you treat a certain segment of the population a certain way, that shit IS going to come back and bite you on the ass. And when my cousin had to live in a derelict building that was not even licensed for occupancy and when the lawyer, Michael F. Cockson, claimed to want to take the case to get compensation for his clients, who he then turned around and sued for their class action settlement monies which saw my cousin receive a lousy $724.15, I knew that Minneapolis was going to get hit and get hit hard. I only had to sit back and wait.

A copy of the settlement check from an $18.5 million lawsuit and this is the amount that my cousin received. Seriously? When Michael F. Cockson’s greedy ass is not even satisfied with $6 million from a lawsuit that was supposed to compensate people for living in slums that were not even licensed by the City of Minneapolis, MN and how could this check get issued when Michael F. Cockson’s appeal for more in Attorney’s Fees had not even been heard? More shenanigans by crooks and liars.

 

And though the law firm that Michael F. Cockson is a partner at is more than likely not leaving downtown Minneapolis, one thing that I am certain about, since COVID-19 came into play law firms have been impacted. I read that many lawyers have lost their job and not only that, the client list is drying up because who can pay for an attorney when millions have lost their jobs and could not even go anywhere for months thanks to COVID-19? So whatever you bought with that six million dollar plus payout, Cockson, I hope it was worth it because I do believe that right now, your ass ain’t sitting so high on the hog. You haven’t hit rock bottom yet, but it is my belief that you will because “as you sow so shall you reap.” And Minneapolis’s whites have got a lot of reaping to do based on the shit they’ve sown for too damn long.

They’re not just fucking shit up where immigrants set up shop, they’ve now figured out that downtown Minneapolis ain’t so special anymore. MINNEAPOLIS (WCCO) — A group of custom cars caused quite the scene Sunday night through downtown Minneapolis.

A WCCO crew saw a group of drivers drag race and do burnouts down Hennepin Avenue as they left a car show and back-to-school giveaway on Nicollet Island outside of DeLaSalle High School.

The whites in Minneapolis can no longer control that shit! And newsflash! It wasn’t Black folks doing burnouts and needing fire hydrants opened. They don’t have the cars for that shit, most definitely NOT if they live in Minnesota!

Now with all the surveillance cameras in downtown Minneapolis, the kops should have no problem finding those whites who were fucking shit up to the point whereas the kops had to turn fire hydrants on. There are surveillance cameras everywhere in downtown Minneapolis and so let’s see who’ll get locked up for this latest shit. I won’t hold my breath.

Why Is The Lamestream Fake News Media Labeling ALL Protests As Black Lives Matter Protests When It Is Quite Obvious, That Is Not The Case???!!!

Why the lamestream media is decrying that ALL protests are Black Lives Matter protests is because they want to ease the public’s collective mind from the realization that whites are going the fuck off because THEY CAN! Check out this latest rioting and looting in Minneapolis, MN that the lamestream media ‘claims’ occurred right after a Black man committed suicide after having been in a confrontation with other people. The claim is that the looting and rioting started ALL over a misunderstanding; that people assumed the KKKops had murdered the man and so went on a looting spree.

Misinformation, police mistrust stir unrest in Minneapolis

Some activists in Minneapolis say the unrest that resulted in 130 arrests and left businesses damaged show the community is on edge

Businesses were burglarized during the unrest and authorities said two officers were injured. The Fire Department responded to four fires at area businesses.

Mayor Jacob Frey and the chief said future violence would not be tolerated, as workers at various businesses boarded up windows and swept broken glass from the sidewalk. Members of the National Guard were activated to help and Frey set another curfew for Thursday night, when officers made more than 30 arrests in the first hour after the curfew but the protests remained mostly peaceful.

And here, we have a video whereas a female reporter is talking about the fact that a CVS was looted and the people who live in the condos above the CVS told her that they” saw several people with chainsaws go inside the CVS.” Now, we are talking about Minneapolis, MN where the poverty rate for Black people is at a whopping 32%. So you tell me, how is it that the majority of looters are Black when Black people cannot even afford housing in Minneapolis, much less do they have money to purchase chainsaws? And so I ask again, “Who is doing the majority of the looting?”

The poverty rate for black people in Minneapolis-St. Paul is 32 percent, which is above even the national average of 26 percent and that is absolutely outrageous. And the Twin Cities has been ranked one of the worst for American descendants of slavery. Less than one-quarter of black Twin Cities residents own their homes, compared to the three-quarters of white residents. And unemployment among black residents is above 12 percent; white unemployment is under 4 percent. But yet, we are to believe that it was unemployed, homeless Black folks with chainsaws who ‘chainsawed’ their way inside a CVS and looted it. “Attorney Michael F. Cockson, You Lost The Appeal For More Attorney’s Fees And So Where Is My Cousin’s Class Action Settlement Money?”

 

 

Some of you may know that I published several posts regarding the fact that my cousin was part of an $18.5 million dollar class action lawsuit because he rented from slumlords who had no valid rental licenses in Minneapolis, MN.

Steve Frenz and Spiros Zorbalas teemed up to run a scam on the City of Minneapolis, MN when the City of Minneapolis, MN ran ‘The Slumlord of Minneapolis’, Spiros Zorbalas, out of Minneapolis by stripping him of his rental licenses on ALL rental properties in Minneapolis, MN.

Then along comes Steve Frenz who told the City of Minneapolis, MN that he had purchased ALL of the properties that had been previously owned by Spiros Zorbalas. The City of Minneapolis, MN then approved rental licenses for the properties that had been owned by Spiros Zorbalas. However, the fact of the matter is that Spiros Zorbalas still owned the rental properties that Steve Frenz claimed he now owned, thus making his rental licenses, null and void. Meanwhile, thousands of mostly low income minority tenants were paying rent to live in vermin and rodent infested buildings that were substandard to say the least in that many had no heat, no hot water, crumbling stairs, unsecured mailboxes, bedbugs and the list is endless.

The City of Minneapolis, MN ‘claimed’ to have no knowledge of the fraud being perpetrated by Spiros Zorbalas and Steve Frenz. Enter Attorney Michael F. Cockson, who was initially contacted by Inquilinxs Unidos, a renters’ union out of Minneapolis, MN that helps immigrants with housing and other issues they face. Attorney Michael F. Cockson, a partner at the law firm, FAEGRE BAKER DANIELS LLP 2200 Wells Fargo Center, 90 South Seventh Street, Minneapolis, MN 55402 agreed to take the case on behalf of Inquilinxs Unidos. However, after learning of the scope of tenants who were adversely impacted by unclean and unsafe building conditions, Judge Mary Vasaly upgraded the case to class action status and said that all former and current renters were to receive ALL rent payments that they had made to Steve Frenz, The Apartment Shop LLC and various other holding companies that Frenz had started up to hide the fact that Spiros Zorbalas still owned the properties that he was acting as front man for.

The case was eventually settled for $18.5 million which was relegated to the coffers of the Settlement Administrators, BrownGreerPLC, located in Richmond, VA, which was to get in excess of $300,000 to send mailings to class members and to mail out checks to class members. Commonbond and another company was named as recipients of checks that should have been relegated to class members and only to class members. See here for details.

However, Attorney Michael F. Cockson was not happy with 25% of the settlement funds awarded to him by Judge Mary Vasaly and so sued his own clients in the Court of Appeals for 32% of the class action settlement funds. Now originally, he would have received over $6 million dollars from a case that he took because he wanted to “Give a voice to those who could not speak for themselves” and to “compensate them for their living conditions” and yet as of today, the appeal for more in Attorney’s Fees for Michael F. Cockson’s greedy ass is still in ‘briefing’ status with the Court of Appeals.

After I blogged about this on June 14, 2019, four days later, the Settlement Administrators called and told my cousin that the settlement checks had been mailed out on June 17, 2019. Below is a copy of the settlement check that my cousin received as his share of the $18.5 million dollar class action lawsuit.

 

So, even though my cousin paid thousands upon thousands in rent to rent an apartment that had multiple safety issues and code violations and was not even licensed to be rented, he received $724.15 while Attorney Michael F. Cockson, a partner at the law firm, FAEGRE BAKER DANIELS LLP 2200 Wells Fargo Center, 90 South Seventh Street, Minneapolis, MN 55402 is suing my cousin and all other members of this class action lawsuit that he initiated on behalf of his clients for more in Attorney’s Fees than what Judge Vasaly approved for his greedy ass. Michael F. Cockson wants more than the over $6 million that has already been taken from his poor, misused and abused clients who had been shitted on by the likes of Spiros Zorbalas and Steve Frenz.

However, Michael Cockson’s greedy ass was stopped in his tracks in trying to collect 32% of the class action settlement in Attorney’s Fees by the Minnesota Court of Appeals because the Minnesota Court of Appeals agreed with the District Court’s decision that granted Michael F. Cockson, 25% in Attorney’s Fees. That greedy bastard, Michael F. Cockson, then petitioned the Minnesota Supreme Court and the Minnesota Supreme Court DENIED his PETITION FOR REVIEW and so the decision of the Minnesota District Court’s decision still stands, your greedy ass was already awarded over $6 million dollars and you wanted more and so the Minnesota Court of Appeals Court said, “FUCK NO!” Now where is my cousin’s goddamn money? Where are your other client’s goddamn money, greedy ass Michael F. Cockson of FAEGRE BAKER DANIELS LLP 2200 Wells Fargo Center, 90 South Seventh Street, Minneapolis, MN 55402, Telephone number: 612-766-8425?

The District Court found that for class action settlements the size of this case and in the consumer category, the average, mean,and median percentages ranged from20% to 26% of the common fund. Appellant concedes there is no case law in Minnesota expressly rejecting the use of empirical studies to determine awards of attorney fees. Moreover, we know of no case that prohibits the use of such studies. The district court did not abuse its discretion when it relied in part on empirical studies to conclude that a fee award of 25% of the common-fund settlement in this case was fair and reasonable.

The district court declined to employ the lodestar method, noting its concerns that the lodestar method “create[s] a temptation for lawyers to run up the number of hours for which they [are] paid.”See In re Union Carbide Corp. Consumer Prods. Bus. Sec. Litig., 724 F.Supp. 160, 167-68 (S.D.N.Y. 1989). Appellant concedes there is no legal authority requiring the district court to perform a lodestar cross-check to confirm the reasonableness of the fee award. Because it is within the district court’s discretion to decline to employ a lodestar cross-check,the district court did not abuse its discretion. Affirmed.

 

Below is the final status of the appeal and as you can see, that greedy bastard, Michael F. Cockson, appealed to the Supreme Court for more in Attorney’s Fees after the Minnesota Court of Appeals upheld the lower court’s decision on his Attorney’s Fees and the Supreme Court DENIED his PETITION FOR FURTHER REVIEW! The District Court’s ruling stands. Your greedy ass was to receive 25% of the settlement and despite your appeals and even your Supreme Court filings, 25% is still what you are to receive and not the 32% that you quite actually, jumped up and down in trying to get. So, where is my cousin’s goddamn money? And for ANY others who were part of this class action lawsuit, get on the phone( 612-766-8425) and call that greedy bastard, Michael F. Cockson, and DEMAND to know when you are to receive the monies that should have been set aside PENDING the out come of his APPEAL for more in Attorney’s Fees than what the judge initially decreed.

 

 

 

Below is the actual outcome of the appeal. The appeal is FINAL. The Minnesota Supreme Court refused to hear the case. The judgment stands.

This particular lawsuit involved more American descendants of slavery than the lawsuits that Attorney Michael F. Cockson previously took on a pro bono basis and so for this particular case, as you can see, he fought long and hard, FOR TWO GODDAMN YEARS to get money that he should have been glad that his clients received since he supposedly took on the case to give justice to those who had been living like shit in unlicensed apartments. But what does he do? Why, he appeals for more in Attorney’s Fees, thus taking money out of the pockets of his very own clients. What goddamn sense does that make?

Michael F. Cockson settled the case knowing that he had settled the case for $18.5 million and he knew how many people would be involved in this class action case, so why then, would he turn around and basically sue his own damn clients for more of the class action settlement in Attorney’s Fees when he was the one who initially settled the case; agreed to the amount? Only to turn right around and get pissed because the judge disagreed with his bloated litigation costs; because make no mistake, that is what this all boils down to. The Rage In Minneapolis, MN Goes Beyond The Cops!

I was reading an article today and the title of the article is:

In Minneapolis, rage over George Floyd extends beyond cops.

True, it does, but the article just continues on in that vein. It does not go further than expounding on how many times Black men have been murdered and/or incarcerated by the ‘system’ of white supremacy that not only controls what goes down in Minneapolis, MN, but controls this entire country. But I want to focus on Minneapolis.

The rage of American descendants of slavery protesters goes way beyond the rage against racist cops. There is a disproportionate number of American descendants of slavery who are homeless in Minneapolis and city leaders as well as community and church leaders are doing everything they can to make sure that continues.

White Minnesotans have for decades, dragged willing Hmongs, Vietnamese, Nigerians, Somalis and Mexicans to Minnesota while at the same time, denied access to necessary services, housing, jobs, educational opportunities; the whole nine yards to American descendants of slavery.

If you find yourself to be homeless in Minneapolis and you are an American descendant of slavery, you will be told by Hennepin County Human Services to contact St. Olaf’s Catholic Church where you must go to be entered into the shelter system. You must then get to St. Olaf Church as soon as possible because the shelter beds fill up quick. Once you arrive at St. Olaf’s Catholic Church, you will be told if there is availability in a homeless shelter, but first, you must answer about 20 questions and receive a ‘shelter pass card’. Below is an actual ‘shelter pass card’.

If you are familiar with Minneapolis, you must ask for a “Handbook of the Streets” and if the church has any, you can obtain one.

A homeless person is supposed to use this to navigate themselves out of homelessness. But when you call the numbers in the handbook, there is NO assistance.

 

Inside the book is where you are supposed to find ALL of the resources to help you out of homelessness and yet why do you think so many people are still homeless in Minneapolis? Especially American descendants of slavery and Indians?

 

This would be why. This is where ALL of the resources are going; to assist immigrants. Those who are American descendants of slavery and the Indians can just remain homeless.

 

And the services for immigrants continues!

 

This is where our tax dollars are going while those who paid those taxes are sitting somewhere underneath bridges or are in fucked up homeless shelters like the one that burned down on Christmas Day 2019. You remember the Drake ‘Hotel’ homeless shelter fire that burned to the ground displacing hundreds of American descendants of slavery.

Call the coordinated entry system and you will find out quick, fast and in a hurry that there is no help; there is no affordable housing. “Hennepin County Front Door,” my ass! I was in the building and I was still told to go to St. Olaf’s Catholic Church. That’s some straight up bullshit that’s in that “Handbook of the Streets.”

If this wasn’t so horrific in that there is no real help to be found here, it would laughable. There is no ‘rapid rehousing’ and they fucking know this!

So after receiving my ‘Community Card’ and the ‘Handbook of the Streets and a bus token depicted below from St. Olaf’s CATHOLIC CHURCH,

What a great help St. Olaf church was. I guess they thought handing me a token for a two and a half hours ride on Metro transit really helped.

 

I was told by the staff at St. Olaf’s Catholic Church that there was a slot available at a homeless shelter, and to make my way on over.

Try sleeping on that. I’ve seen pictures of prison cell beds that were more comfortable.

That thin shit is on top of steel and there is no rapid re-entry into permanent, affordable housing from that. I actually spoke with women who were trying to save money just so that they could spend some nights in a hotel in order to feel what a real bed is like. This is what churches and so-called ‘charities’ are doing to people, namely American descendants of slavery. The Indians refuse to even go into those places and so they just set up tents.

 

As you can see, the rage that was exhibited in Minneapolis was not just due to racist police, but was a direct result of the conditions that American descendants of slavery have to exist in. And this is ALL done by design. There are more resources available for immigrants/refugees than there are for people who are treated as though they are refugees in the country of their birth.

Oh yes indeed, Minnesota is very welcoming; you just have to be coming from Somalia, Cambodia, Ethiopia, Laos and Mexico. If you were born in America and you happen to be an American descendant of slavery, Minnesota doesn’t welcome you. And even though I went to ST. OLAF’S CATHOLIC CHURCH, I received none of the assistance that those from Somalia, Cambodia, Ethiopia, Laos and Mexico receive. You see, those folks head right into affordable housing, paid for by our tax dollars while those of us who are descendants of slavery can just head on over to a piece of shit homeless shelter and sit up in there for ‘god’ only knows how long. I met Black women who had been living in that homeless shelter for over a year, some had been there for two years IN A HOMELESS SHELTER. How they could stand it, I don’t know because the conditions in there were deplorable, unsanitary and down right dangerous! I lasted ONE goddamn night in there! There was NOT ONE immigrant sitting up in that shelter, NOT ONE! How is that just by any stretch of the imagination? Charity begins at home. You don’t drag folks, willingly over here and throw the services at them while treating those who are in the same boat, refugees in their own country, as if they are dirt, but that is exactly what is happening in Minneapolis, MN. The shit that I have seen would curl your toes. They damn near curled mine.

I don’t just read up on shit! I go and see for myself what the fuck’s going down and I always have PROOF of the fact that I know what the fuck I’m talking about BEFORE I speak on a subject. So don’t goddamn tell me that there are NO AFFORDABLE HOUSING in Minneapolis because there damn well is, but you must be from SOMALIA, CAMBODIA, ETHIOPIA, LAOS AND MEXICO TO GET IT! American descendants of slavery need NOT APPLY!

As you can see from the article, CATHOLIC SOCIAL SERVICES AGENCIES help immigrants into housing, jobs, good medical care; the whole nine yards, but as an American descendant of slaves, we are sent to homeless shelters like the one that burned down on Christmas Day of last year; the fucking Drake Hotel.

People have been castigating the protesters for “burning down their own neighborhoods.” Go to Minneapolis and find one neighborhood that is loaded down with American descendants of slavery. I’ll save you the trouble, there are none. Eighteen percent of the twenty percent of Black people who reside in Minnesota are homeless or housing insecure because the vast majority of affordable housing units go to house immigrants. Now you tell me, what did American descendants of slavery have to lose in Minneapolis? I’ll tell you; not a goddamn thing! Minneapolis is bemoaning some shit that was fucked up and was owned by some damn immigrants. Fuck them!

It is a sad ass shame that the only way those of us who are descendants of slaves who were dragged over here to ‘serve’ the white man AND white woman’s every whim, can expect to get any peace from them is by being murdered at their hands. Poor Black people, who mostly cannot even afford life insurance, have to make use of crowd funding or either some ‘celebrity’ will come forward to pay for the funeral expenses. From cradle to grave, we are to forever hand the white man some money while he is busy killing us since many Black women’s babies die in childbirth in this supposedly, First World Nation. What sense does that make? And even if we make it to our teenage years, we are still murdered for merely coming home from a store, carrying iced tea and skittles. Our children cannot even play in a park without getting shot dead. We cannot drive down the street without getting pulled over and shot for complying with the orders to produce our identification. We cannot sleep in our beds without kops beating down the door and shooting us as we lay deep in slumber and yet, none are held accountable for what they do to us.

And now, another Black family, the family of George Floyd, is about set to bury him because he went into a store and was accused of trying to purchase items with a counterfeit bill, and I have heard that even that was a lie. But even so, was that any reason for a racist kop to murder him, casually as though he was merely a bug to be squashed on the sidewalk? As if that is not bad enough, a stomp down, flaming racist, draft dodging bigot has the nerve to order the U.S. military to ‘put us down’ when he was scared too shitless to even join the very military he has called out on us. What sense does that make?

But you whites want to write blog after blog about how ‘woke’ your ass is now! You ain’t woke. Per the criminal complaint against Chauvin, Floyd did not die of traumatic asphyxia or strangulation. According to the Hennepin County Medical Examiner’s Office, Floyd’s death was the result of being “restrained by the police, his underlying health conditions and any potential intoxicants in his system.”

So, people are to disbelieve what their eyes saw in the video? George Floyd did NOT have any kop applying a knee to his neck while other kops applied pressure to other parts of his body? Nope, George Floyd died because he had COVID-19, congestive heart failure, diabetes, COPD, Traumatic Brain Injury, lupus, chronic gout disease, pancreatitis, severe neck sprain and vicious heartburn which led to a heart attack and all of this decided to become problematic at the exact same moment when officer Klan Chauvin was merely trying to soothe George Floyd’s aching neck with his knee before escorting him to jail over an alleged counterfeit bill? For real???!! Seriously???!!!

I knew that the lies that would be put out would be dreadfully outrageous! We ALL saw what caused the death of George Floyd. George Floyd, if he had any ‘underlying medical conditions’, would have still been alive if NOT for the fact that officer Klan Chauvin knelt down and applied pressure to his neck for damn near 10 minutes. No one said that officer Klan Chauvin wrapped his hands around George Floyd’s neck and choked him, thus ‘traumatically asphyxiating or strangling’ him. He used his knee and his entire body weight to apply pressure on the neck of George Floyd until he knew that George Floyd was no longer breathing and that there was no chance in hell that George Floyd could EVER be resuscitated. And no, I have not watched the video. My cousin watched the video and informed me of what he saw. There is no way in hell that I can even bring myself to watch even a second of that video, for if I did, I refuse to be held accountable for my actions.

The kops are also stating that officer Klan Chauvin has been moved to different jails, twice. Of course he is being moved around because the rest of the inmates are more than likely going the fuck off since officer Klan Chauvin would likely bring about their deaths just by being in close proximity to the other prisoners since the Hennepin County Medical Examiner’s Office would have us believe that officer Klan Chauvin did nothing to cause the death of George Floyd beyond being in his vicinity at the time of his death.

These racist white shits are still at it and yet are wondering why the protests are still going on; they are going on because Black people know the deal. We know that racists have been finding ways for other racists to get off on doing their fucking dirty, racist shit to us and that shit has not ceased despite days of protesting.

Independent Autopsy Finds George Floyd’s Death Homicide Caused by Asphyxia

An independent autopsy conducted at the request of George Floyd’s family found he died as a direct result of the pressure placed on his body by the three Minneapolis police officers on the scene, coming in direct conflict with part of the preliminary findings of the Hennepin County Medical Examiner’s office last week.

Even though there was “no harm to his trachea,” Floyd attorney Benjamin Crump said, the pressure placed on his body by all of the officers—and not just Derek Chauvin—caused Floyd’s death.

“Asphyxia due to compression of the neck” cutting off blood flow to Floyd’s brain and neck directly caused his death, Baden added.

“He would be alive today if not for the pressure applied to his neck by fired office Derek Chauvin and the strain on his body from the two additional officers kneeing him in his back,” Crump said Monday at the press conference.

“Not only was the knee on George’s neck a cause of his death but so was the weight of the other two police officers on his back, who not only prevented blood flow into his brain, but also airflow into his lungs. That makes all of those officers on the scene criminally liable and without a doubt, civilly responsible.” co-counsel Romanucci added.

Now get to arresting those other racist kops! They are ALL complicit in the murder of George Floyd! Now there is no excuse to continue to allow those racist, criminal thugs to walk free. I just looked up the owner of Cup Foods and voila! I was right. The owner is Mahmod Abumayaleh, who stated that many times customers come in with counterfeit money and don’t even know it’s counterfeit. He stated that if he had been in his convenience store at the time George Floyd was in there, the police would not have been called. And so I guess that it just wasn’t George Floyd’s lucky day in that Mahmod Abumayaleh was not there to tell the clerk that there was no need for police involvement, however, that is cold comfort to George Floyd since he is cold and lying on a coroner’s slab in the morgue having an autopsy performed on him so that more lies can come out as to how he died. I am pretty sure that we are going to be told that George Floyd was already dead BEFORE Officer Klan Chauvin even placed his knee on George Floyd’s neck. I mean, they’ve told countless lies already as to what occurred, in that George Floyd resisted arrest and had to be manhandled. Well, another store owner handed over a video that shows just the opposite of the kops’ lies.

And even with knowing that the kops have already begun with the lies, people who look like George Floyd should just continue to march, peacefully through the streets at allotted times and on allotted days until the white man tells them, that’s enough? Seriously??!!! They’d better not ground capitalism to a halt especially since Donald Trump just ordered the reopening of this vile shithole that coronavirus had put on lockdown.

So what??!! A goddamn AutoZone was burned to the ground. So what??!! A new apartment building was burned to the ground; those damn buildings are insured and so the rebuilding can start right away. There is no ‘rebuilding’ of George Floyd. There is no amount of insurance that can bring George Floyd back to life. And how BIG of the owner of Cup Foods to state that he “has offered to pay for Floyd’s funeral expenses.”

But as of yet, no charges have been filed against ANY of the THUGS IN BLUE UNIFORMS that took the life of George Floyd. I see, Donald Trump did NOT call those THUGS exactly what they are, GOVERNMENT SANCTIONED THUGS, and he won’t. We are to sit back and twiddle our thumbs and wait on the slow ass process of the criminal injustice system to do not a goddamn thing! The criminal injustice system is quick to dish out punishment and death to us, but when their no account asses have been found to do some filthy, dirty ass, horrendous shit, we are to sit and wait for the slow ass cogs of the law to start turning. I am glad Metro Transit had to shut the bus service and the light rail down. I am damn glad that 24 Target stores had to close their goddamn doors. I wrote those two poems in 2015 and 2016 and yet they still apply today. Tell me, what the fuck has changed? But yeah! We are supposed to sit the fuck down and shut the fuck up about the continuation of this shit! I don’t blame the protesters for going the fuck off. I just wish I was there with them. I wish the shit that they are doing, they’d NEVER stop doing it, but alas, my wish is in vain because this has ALL happened so many times before and it will happen again.

And as usual, when Black people go the fuck off and with GOOD GODDAMN REASON, we are always labeled, “THUGS” by the white establishment. This is what ‘our’ so called, ‘president’ thinks of American descendants of slavery. But when white males go on killing sprees, they are merely labeled, “mentally ill.” And if the Muslims get to fucking shit up because they get goddamn tired of the shit done to them by the whites, they are labeled, “terrorists!” Oh, the hypocrisy and double standards are glaringly obvious. The biggest THUGS and criminals and terrorists on this goddamn planet are WHITES and you fuckers are indeed, insane, but your insanity, you gladly embrace; fucking deranged sociopaths!
